4. Website Information and Enquiries

The information on our website is provided for general informational purposes and to help prospective clients understand our services.

Submitting a contact form, requesting a consultation, contacting us by email or telephone, or communicating through WhatsApp does not automatically establish a formal professional engagement.

We may need to assess your requirements, verify relevant information, conduct appropriate client checks, and agree on the scope, fees, and responsibilities before commencing any work.

We reserve the right to decline an engagement where appropriate, subject to applicable law and any existing contractual obligations.

5. Consultations and Proposals

Initial enquiries and consultations are subject to the arrangements communicated to you at the time of booking.

Any consultation fee, where applicable, will be communicated before the consultation takes place.

Where we provide a quotation or proposal, it will specify the relevant services, scope of work, applicable fees, estimated timeline, and other material conditions, where appropriate.

Unless otherwise stated, quotations are based on the information supplied by the client and may need to be revised if the requirements, circumstances, or scope of work change.

A formal engagement will commence once the relevant proposal or engagement terms have been accepted and any required payment, documentation, or onboarding requirements have been completed.

6. Fees, Payments and Additional Charges

Our fees depend on the nature, complexity, and scope of the services required.

Before commencing chargeable work, we will communicate the applicable fees and payment arrangements through a quotation, proposal, engagement letter, or other agreed written communication.

Unless otherwise agreed in writing:

  • Clients must pay invoices according to the stated payment terms.

  • Additional work outside the agreed scope may incur additional charges.

  • Government fees, licensing fees, visa fees, free zone charges, regulatory fees, third-party professional fees, and other external costs may be payable separately.

  • Any applicable VAT or other taxes will be charged in accordance with applicable law.

  • Payments made to government authorities or third parties may be subject to their own terms and refund policies.

We will communicate material additional charges before proceeding with additional chargeable work, where reasonably practicable.

Nothing in this section limits any refund, compensation, or other rights that a client may have under applicable law.

7. Client Responsibilities

To enable us to provide our services effectively, you agree to:

  1. Provide complete, accurate, and up-to-date information.

  2. Supply requested documents within reasonable or agreed timeframes.

  3. Inform us promptly of changes to your business, financial circumstances, ownership, contact details, or other relevant information.

  4. Review documents, applications, reports, and information provided to you.

  5. Respond to requests for clarification or approval when required.

  6. Make payments by the agreed due dates.

  7. Ensure that documents and information supplied to us may lawfully be shared for the intended purpose.

  8. Comply with your own legal, tax, regulatory, and reporting obligations.

We are not responsible for delays or errors caused by incomplete, inaccurate, misleading, or late information supplied by a client or by a third party, except to the extent that applicable law provides otherwise or the matter results from our own failure to meet an applicable obligation.

8. Company Formation, Licensing and Visa Assistance

Arabian Advisors may assist clients with company formation, free zone setup, business licensing, licence renewals, amendments, cancellations, visa-related applications, and associated administrative procedures.

These services may involve government departments, free zone authorities, immigration authorities, banks, landlords, service providers, or other third parties.

We provide assistance within the scope agreed with the client. Unless expressly agreed otherwise and legally permitted, we do not exercise the decision-making powers of government authorities or other independent organisations.

Approval of a company formation application, business licence, visa, bank account, residency application, or other third-party application is not guaranteed.

Processing times, eligibility requirements, documentation requirements, fees, and approval decisions may change and may be outside our control.

Clients remain responsible for providing accurate documents, meeting eligibility requirements, attending appointments where necessary, and complying with applicable laws and authority requirements.

9. Accounting, Taxation and Financial Services

Our accounting, bookkeeping, corporate tax, VAT, financial reporting, audit, and related services are provided according to the scope agreed with each client.

Advice and recommendations may depend on the accuracy and completeness of information provided, the client’s particular circumstances, and the laws, regulations, and official guidance applicable at the relevant time.

Unless expressly agreed in writing, we do not undertake to continuously monitor changes in legislation or update previously issued advice after the engagement has ended.

Clients remain responsible for reviewing their obligations, supplying the necessary records, approving relevant submissions where required, and ensuring that information provided to authorities is accurate.

Where a service requires a licensed, registered, or otherwise authorised professional, it will only be undertaken through an appropriately qualified and authorised provider in accordance with applicable requirements.

No provision of these Terms & Conditions removes any professional duty or legal obligation that applies to the services provided.

10. No Guarantee of Results

We aim to provide professional, careful, and appropriate support based on the information available to us.

However, unless a specific outcome is expressly guaranteed in a written agreement and such a guarantee is legally permissible, we do not guarantee:

  • Approval of company formation or business licence applications.

  • Approval of visas, residency applications, or bank accounts.

  • A particular tax treatment, tax saving, financial result, or business outcome.

  • Acceptance of accounts, financial statements, or applications by a third party.

  • Completion within a particular period where timing depends on a government authority, regulator, bank, or other third party.

Any timelines communicated to clients are estimates unless expressly confirmed as binding in writing.

11. Confidentiality and Client Information

We understand that clients may provide confidential commercial, financial, personal, and corporate information when requesting our services.

We will handle such information in accordance with our contractual obligations and applicable data protection and confidentiality requirements.

We may disclose information where necessary to perform agreed services, obtain assistance from authorised service providers, comply with applicable law, respond to lawful requests from competent authorities, or protect our legitimate legal interests.

Where appropriate, we will take reasonable steps to ensure that third parties receiving confidential information are subject to suitable confidentiality and data protection safeguards.

Further details about the collection, use, storage, and disclosure of personal information are provided in our Privacy Policy.

12. Data Protection and Communications

When you submit an enquiry through our website, we may collect information such as your name, email address, telephone number, requested service, and the details you choose to provide.

We use this information to respond to enquiries, assess service requirements, arrange consultations, communicate with clients, and take appropriate steps towards providing requested services.

We will handle personal information in accordance with applicable UAE data protection legislation and other laws that apply to our business.

We will not use personal information for promotional or marketing purposes in a manner prohibited by applicable law. Where consent or another lawful basis is required, we will obtain or rely on the appropriate basis.

You should avoid submitting passwords, payment card details, or unnecessary sensitive information through general website enquiry forms.

13. Website Use and Intellectual Property

Unless otherwise indicated, the content of our website, including its text, graphics, branding, design, and other materials, is owned by Arabian Advisors or used with appropriate permission.

You may access and use our website for lawful personal or business purposes.

You must not:

  • Copy, reproduce, distribute, or commercially exploit our website content without appropriate permission.

  • Attempt to gain unauthorised access to our website, servers, or systems.

  • Introduce malicious code, viruses, or other harmful material.

  • Use our website to submit fraudulent, unlawful, misleading, or abusive content.

  • Use our branding or materials in a way that misrepresents an association with our business.

Nothing in this section restricts any rights or uses permitted by applicable law.

14. Third-Party Websites and Services

Our website may contain links to external websites, government portals, free zone authorities, payment providers, or other third-party services.

These links are provided for convenience or informational purposes.

We do not control third-party websites and are not responsible for their content, availability, security, privacy practices, decisions, or service terms.

Clients should review the relevant third-party terms and policies before using those services or submitting information to them.

15. Cancellations, Termination and Refunds

The cancellation or termination of a service engagement will be governed by the applicable proposal, engagement letter, or written agreement.

Where no specific arrangement has been agreed, either party may request termination by giving reasonable written notice, subject to outstanding contractual obligations and applicable law.

Upon termination, clients may be responsible for fees for work properly performed up to the effective termination date and for authorised, non-recoverable third-party costs incurred on their behalf, subject to the agreed engagement and applicable law.

Any refund entitlement will be assessed according to the agreed terms, the services performed, applicable third-party refund rules, and applicable UAE law.

We will not apply a blanket no-refund rule where a refund or other remedy is required by law.

Termination does not remove obligations or liabilities that arose before termination or any provisions intended to continue afterwards.

16. Limitation of Liability

To the extent permitted by applicable law, Arabian Advisors will not be liable for indirect or consequential losses that are not legally recoverable, including loss of anticipated profits, business opportunities, or expected savings.

We are not responsible for independent decisions, processing delays, service interruptions, or actions of government authorities, regulators, banks, free zone authorities, or other third parties, except where liability arises from our own breach of an applicable obligation or as otherwise provided by law.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including any applicable liability arising from fraud, wilful misconduct, or other non-excludable obligations.

Any agreed contractual limitation of liability must be expressly set out in the applicable engagement terms and remain lawful and enforceable.

17. Events Beyond Our Reasonable Control

We will not be responsible for delays caused by circumstances beyond our reasonable control, to the extent permitted by law.

Such circumstances may include government service interruptions, regulatory changes, natural disasters, public emergencies, widespread technical failures, or interruptions affecting third-party systems.

Where such circumstances affect an ongoing engagement, we will make reasonable efforts to communicate the impact and discuss appropriate next steps.

This section does not remove any obligations or remedies that continue to apply under applicable law.

18. Changes to These Terms

We may update these Terms & Conditions when necessary to reflect changes to our website, services, business practices, or applicable legal requirements.

The revised version will be published on this page with an updated “Last Updated” date.

Changes will apply prospectively where appropriate. Material changes to an existing client engagement will be handled in accordance with the applicable agreement and relevant law.

We encourage visitors to review this page periodically.

19. Governing Law and Dispute Resolution

These Terms & Conditions are intended to be governed by the applicable laws of the United Arab Emirates and, where applicable, the laws in force in the Emirate of Dubai.

If a dispute arises, the parties should first attempt to resolve it through good-faith discussions.

If the dispute cannot be resolved amicably, it may be referred to the competent courts or other competent dispute-resolution bodies in Dubai, as applicable under the governing law and any valid agreement between the parties.

Nothing in this section prevents a consumer or other entitled person from exercising a right or pursuing a remedy before a competent authority or court where permitted by applicable law.

20. Severability

If any provision of these Terms & Conditions is held to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Any invalid provision will be interpreted or adjusted only to the extent necessary to make it lawful and enforceable, where legally possible.

21. Entire Agreement

These Terms & Conditions govern general use of our website.

For paid professional services, a separate proposal, engagement letter, service agreement, or other written contract may contain additional terms specific to that engagement.

If a specific written engagement agreement conflicts with these general website terms, the engagement agreement will prevail for that particular engagement to the extent permitted by law.

Nothing in this section overrides mandatory legal requirements.
